§ 2. Franchise granted; term.

  • That pursuant to Article XII, Section 228, Constitution of Alabama, 1901, there is hereby granted to the corporation for a period of thirty (30) years from the effective date of the ordinance from which this article derives and only to the extent of this ordinance and the franchise granted herein, the right, privilege, authority, consent and franchise to construct, own, maintain, extend and enlarge and operate in the city, a plant or system, together with the right, privilege, authority, consent and franchise to lay, construct and maintain its mains, conduits, appliances, fixtures and related appurtenances in, along, across and under the streets, avenues, alleys, bridges, or public ways of the city, for the manufacture, transmission, distribution and sale of gas in and through the city and in the territory contiguous thereto, and to repair, renew, relay and extend such mains, conduits, appliances, fixtures and related appurtenances, and to make all excavations necessary therefor. It is expressly understood that the franchise granted herein is a privilege and not a right.
